AI Acceptable Use Policy

End User License Agreement

1. Purpose and Scope

This AI Acceptable Use Policy (the “AI AUP”) governs the use of the AI-powered features of The Boring Toolbox (the “AI Features”) by customers and their authorized users. This AI AUP is the “AI AUP” referenced in, and incorporated by reference into, the AI Features Supplement (Addendum B) to the End User License Agreement and Terms of Service between The Boring Lab, LLC (“The Boring Lab,” “we,” or “us”) and the customer (the “Agreement”).

By enabling or using AI Features, you agree to this AI AUP. Capitalized terms used but not defined in this AI AUP have the meanings given to them in the Agreement or the AI Features Supplement. In the event of a conflict between this AI AUP and the AI Features Supplement, the AI Features Supplement controls.

2. How AI Features Operate

The AI Features are operated by The Boring Lab as an embedded, backend capability of The Boring Toolbox. Customers and authorized users do not directly access, prompt, fine-tune, or otherwise interact with the underlying AI models. Instead, the AI Features automatically process inputs from your environment and surface health metadata, analysis, and insights to you within the product.

As of the effective date, the AI Features include:

  • Image Health Analysis — AI-assisted analysis of point-in-time images from your Video Management System (“VMS”) to identify anomalies, quality issues, or health indicators; and
  • System Health Data Analysis — AI-assisted analysis of system telemetry and operational data to surface health indicators and patterns.

The AI Features are delivered using Microsoft Azure AI Services, operated by Microsoft Corporation. References in this AI AUP to “AI Customer Input” and “AI Customer Output” mean, respectively, the data submitted to the AI Features from your environment and the analysis, metadata, and other content the AI Features generate in response.

3. Permitted Use

You may use the AI Features and AI Customer Output solely for your own internal business purposes of operating and monitoring your systems, as enabled within The Boring Toolbox and in accordance with the Agreement, this AI AUP, and applicable law.

4. Prohibited Uses

You shall not, and shall not permit any authorized user to, directly or indirectly:

  • use the AI Features or any AI Customer Output to develop, train, or improve any other artificial intelligence or machine learning technology;
  • use web scraping, web harvesting, web data extraction, or any other method to extract data from the AI Features or any AI Customer Output;
  • reproduce training data, engage in model extraction, or otherwise attempt to discover, access, or derive any source code, algorithm, model, model weights or parameters, or other underlying AI technology or component of the AI Features, in whole or in part;
  • attempt to circumvent, disable, degrade, or interfere with any technical, operational, rate-limiting, or safety controls applied to the AI Features;
  • use the AI Features or AI Customer Output in any manner that infringes, misappropriates, or otherwise violates the intellectual property, privacy, or other rights of any person, or that violates any applicable law;
  • input or otherwise cause the AI Features to process any personal information or sensitive or special-category personal data, except as expressly permitted under Section 5 and the Agreement; or
  • rely on AI Customer Output as the sole basis for any decision that produces legal, safety-critical, or similarly significant effects without appropriate human review, or otherwise use the AI Features in a deceptive, misleading, or unlawful manner.

5. Data You Make Available to the AI Features

Because the AI Features process data drawn from your environment, you are responsible for the data made available to them. You represent and warrant that you have and will maintain all rights, permissions, consents, and lawful bases necessary to submit that data — including images captured by your VMS and system telemetry — for processing as described in the Agreement and the AI Features Supplement.

The AI Features are not intended to process personal information. Images from VMS installations may incidentally capture individuals within the camera field of view. The Boring Lab does not control the content of images captured by your VMS and does not use any individuals appearing in images for identification or for any purpose other than performing the AI Features. You are responsible for ensuring that your use of the AI Features complies with all applicable privacy and data-protection laws, including any notice or consent obligations you may owe to individuals who may appear in those images. You must not intentionally submit personal information or sensitive personal data to the AI Features unless you have obtained all necessary consents and such submission complies with applicable law and your agreements.

6. Human Oversight and Reliance on Outputs

AI Customer Output is informational and is intended to support — not replace — human judgment and review. The AI Features may produce inaccurate, incomplete, or unexpected results; isolated errors are a normal characteristic of AI technology and do not constitute a service failure. You are solely responsible for evaluating the suitability of the AI Features for your intended use, maintaining appropriate human oversight and monitoring, and for any decisions, actions, or omissions made in reliance on AI Customer Output.

7. Third-Party AI Services

The AI Features are delivered using Microsoft Azure AI Services, operated by Microsoft Corporation. Data transmitted to Microsoft Azure AI Services is processed in accordance with Microsoft’s applicable service terms, and Microsoft does not use your data to train or improve its AI models without consent. Your use of the AI Features is also subject to any applicable third-party terms as described in the Documentation or service-specific terms, as they may be updated from time to time.

8. Monitoring, Suspension, and Enforcement

The Boring Lab may monitor use of the AI Features for security, quality, and compliance purposes. We may suspend, restrict, or terminate access to all or any part of the AI Features, with or without notice, where we reasonably believe it is necessary to prevent harm, protect the Services or other customers, comply with applicable law, or address a violation of this AI AUP, in each case consistent with the Agreement and the AI Features Supplement. A violation of this AI AUP is a breach of the Agreement, and the indemnification and other remedies set out in the Agreement and the AI Features Supplement apply.

9. Changes to this AI AUP

The Boring Lab may update this AI AUP from time to time. The current version will be posted at the URL where this AI AUP is published, and, where a change is material, we will provide notice consistent with the Agreement. Your continued use of the AI Features after an update takes effect constitutes acceptance of the updated AI AUP.
